These Terms of Service govern your use of empyrewater.com, operated by Empyre Water Co LLC, a Colorado limited liability company. By using the site you agree to them. Work we perform at your property is governed by the separate written proposal and contract you sign, and that contract controls if anything here conflicts with it.
2. Information on this site is general
Water quality figures published on this site are taken from the public reports of the utilities and government agencies named beside them and are attributed to the year those bodies reported them. We publish them in good faith and link the source so you can verify them yourself.
Water quality changes over time and varies by address, plumbing, and season. A published system-wide figure describes a utility's system, not your tap. Nothing on this site is a representation about the water at any specific property. Only an on-site test can tell you that.
All water systems referenced on this site were reported by their utilities as meeting applicable federal and state drinking water standards for the periods cited. Nothing on this site is a claim that any public water supply is unsafe or out of compliance.
3. Not medical advice
Empyre Water Co does not diagnose, treat, cure or prevent any disease or medical condition. Nothing on this site is medical advice. If you have a health concern relating to your drinking water — including questions about sodium intake, nitrate and infants, or any other exposure — consult a qualified medical professional.
4. Pricing and quotes
This website does not publish prices, and nothing on it is an offer or a quote. Your price depends on your water test results, your home's plumbing, equipment selection, and permit fees in your jurisdiction. A price becomes binding only in a written proposal signed by both parties. We do not use expiring or same-day-only discounts.
5. Performance of equipment
Contaminant reduction performance depends on the specific system installed, its installation, your source water, and adherence to the maintenance schedule. Where a component carries third-party certification we will provide the manufacturer's certification documentation for that component on request. We make no performance representation beyond what those documents and your signed proposal state.
6. Maintenance is your responsibility
Filtration and treatment equipment requires scheduled service. Equipment operated past its service interval may not perform as intended. Whether or not you buy a service plan, maintaining your system on schedule is your responsibility.
7. Communications
By submitting a form you agree we may contact you about your request. If you check the consent box you additionally agree to calls and texts at the number provided, including by automated means. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out.
8. Intellectual property
The content, design, brand marks and compiled water quality tables on this site are the property of Empyre Water Co LLC, except for material sourced from public agency reports, which remains the property of those agencies. You may not reproduce our content commercially without written permission.
9. Third-party links
We link to utility and government documents so you can verify our figures. We don't control those sites and aren't responsible for their content or availability.
10. Disclaimer and limitation of liability
This website is provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by Colorado law. To the maximum extent permitted by law, Empyre Water Co LLC is not liable for indirect, incidental, consequential or punitive damages arising from your use of this website. Nothing in this section limits any warranty or obligation in a signed installation contract, or any liability that cannot be limited under Colorado law.

These terms are governed by the laws of the State of Colorado. Venue for any dispute lies in El Paso County, Colorado.
